Insurance tax (Versicherungsteuer)

The insurance tax, which belongs to the transaction taxes, is based on the payment of insurance moneys (premiums, contributions). Whether the insurance relations were established by way of a contract or other method (e.g. law) is of no importance. Excluded are, however, all statutory and private life and health insurances as well as the statutory unemployment insurance.

Tax debtor is the insured. The tax is, however, paid as a rule by the insurance company. If the insurance relations exist between an insurer who is located outside of the European Union (EU) or other contractual state of the European Economic Area (EEA), the insured must hand in a tax return to the tax office and pay the tax he has calculated himself. If the insured must pay the tax, he must also notify the conclusion of the insurance to the tax office immediately.
 
The insurance tax is always calculated from the insurance consideration, in the case of hail insurance from the insured sum.
 
The regular tax rate is 19 percent. There are insurances which deviate from this and have a lesser charge.
